MekTechs provides managed IT services, including but not limited to:
- 24/7 IT monitoring and support
- Cybersecurity solutions and threat protection
- IT automation and workflow optimization
- Cloud services and migration
- Help desk and technical support
- Backup and disaster recovery services
- Compliance and security assessments
3. Service Level Agreements
Uptime Guarantee
We guarantee 99.9% uptime for our monitoring services. If we fail to meet this standard, you may be eligible for service credits as outlined in your service agreement.
Response Times
- Critical Issues: 15 minutes or less
- High Priority: 1 hour or less
- Medium Priority: 4 hours or less
- Low Priority: Next business day
4. Client Responsibilities
As a client, you agree to:
- Provide accurate and complete information about your IT environment
- Grant necessary access to systems and networks for service delivery
- Maintain current backups of critical data
- Follow security best practices and policies
- Pay all fees and charges in accordance with the agreed terms
- Notify us promptly of any changes to your IT infrastructure
- Comply with all applicable laws and regulations
5. Payment Terms
Billing
- Services are billed monthly in advance
- Payment is due within 30 days of invoice date
- Late payments may incur additional charges
- Services may be suspended for non-payment
Pricing Changes
We reserve the right to modify our pricing with 30 days' written notice. Existing contracts will honor the original pricing for the duration of the contract term.
6. Data Protection and Confidentiality
We are committed to protecting your data and maintaining confidentiality:
- All client data is treated as confidential
- We implement industry-standard security measures
- Data is encrypted in transit and at rest
- Access to client data is restricted to authorized personnel
- We comply with applicable data protection regulations
7. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability shall not exceed the amount paid for services in the 12 months preceding the claim
- We are not liable for indirect, incidental, or consequential damages
- We are not responsible for data loss due to client actions or third-party failures
- Force majeure events are excluded from liability
8. Intellectual Property
Our Property
All intellectual property rights in our services, software, and documentation remain our property or that of our licensors.
Client Property
You retain all rights to your data and intellectual property. We claim no ownership rights over your content.
9. Termination
Termination by Client
You may terminate services with 30 days' written notice. Early termination fees may apply for contracted services.
Termination by MekTechs
We may terminate services immediately for:
- Non-payment of fees
- Breach of terms and conditions
- Illegal or harmful activities
- Failure to provide necessary access or cooperation
Data Return
Upon termination, we will provide you with your data in a standard format within 30 days, subject to payment of all outstanding fees.
10. Acceptable Use Policy
You agree not to use our services for:
- Illegal activities or violation of laws
- Harassment, abuse, or harm to others
- Spam, phishing, or malicious activities
- Unauthorized access to systems or networks
- Distribution of malware or viruses
- Activities that could damage our reputation or services
11. Force Majeure
We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, labor disputes, or government actions.
12. Governing Law
These terms are governed by the laws of the United States and the state in which our services are provided. Any disputes will be resolved through binding arbitration or in the appropriate courts.
13. Changes to Terms
We reserve the right to modify these terms at any time. We will provide notice of material changes through:
- Email notification to registered users
- Posting updates on our website
- Notice through our service platform
Continued use of our services after changes constitutes acceptance of the new terms.
14. Severability
If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
